Terms of Service
Last updated: 29 August 2026
These Terms provide a general framework for using the Blue Cherry Media website and enquiring about our video production services. Each confirmed project is also governed by the agreed proposal, quote and production terms for that project.
Who we are
Blue Cherry Media is a trading name of TVIP Studios Limited, a company registered in Ireland (CRO number 823733). Our registered office is 73 Threadneedle Road, Galway, H91 NWD1, Ireland. References to "Blue Cherry Media", "we", "us" or "our" in these Terms mean TVIP Studios Limited.
About our services
Blue Cherry Media provides video production, photography, editing, creative direction and related content services. The exact scope, deliverables, schedule and fee for a project will be confirmed in writing before work begins.
Enquiries, quotes and booking
An enquiry or quote request does not create a contract. A project becomes confirmed when both parties accept the written proposal or agreement and any required deposit or booking payment has been received.
Quotes are based on the information available at the time and may need to change if the scope, locations, schedule, deliverables or production requirements change.
Client responsibilities
The client is responsible for providing accurate project information, timely feedback, access to agreed locations and any permissions, releases, licences or approvals needed for the work. Delays caused by missing information, access or approvals may affect the schedule and cost.
Payment
Payment dates, deposits, staged payments, VAT and expenses will be set out in the project proposal or invoice. Unless otherwise agreed in writing, invoices are payable by the due date shown on the invoice. We may pause work or withhold final delivery where an undisputed payment is overdue.
Changes, cancellations and rescheduling
Changes to a confirmed brief may affect the fee and delivery date. Cancellation or rescheduling terms will be set out in the project agreement and will take account of work completed, non-refundable costs and dates reserved for the production.
Intellectual property and usage
Blue Cherry Media retains ownership of working files, unused footage, project files, templates and production methods unless the project agreement states otherwise. The client receives the usage rights for the agreed final deliverables once the relevant invoices have been paid in full.
The client must ensure that materials supplied to us can be used for the project. We may use completed work for our portfolio or marketing only where the project agreement permits it or the client has given permission.
Events outside our control
We will make reasonable efforts to deliver the work as agreed, but we are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, illness, venue restrictions, travel disruption, equipment failure or changes required by law.
Liability
Nothing in these terms limits liability that cannot legally be limited. Subject to that, our liability will be limited to the amount paid for the affected project, except where a different limit is agreed in writing. We are not liable for indirect or consequential losses such as loss of profit, opportunity or reputation.
Governing law
These Terms are governed by the laws of Ireland. The Irish courts will have jurisdiction over disputes, subject to any rights that cannot legally be excluded.
